Terms and Conditions

These Terms and Conditions apply to all purchases from our website. Please read them carefully before placing an order.

1.	Acceptance of your order:	We must receive payment of the price of the products and the delivery charges (if applicable) before we can accept your order. We reserve the right to restrict the number of products you may order and to refuse any order. If you have provided us with your e-mail address you will receive an e-mail from us confirming that we have received your order. This e-mail is sent automatically and does not mean that we have accepted your order. We will notify acceptance of your order by sending an e-mail to you stating that your order has been accepted and despatched. Otherwise, our acceptance of your order takes place upon delivery of the products. Only when we have accepted your order is a binding contract created between us.
2.	Prices:	Unless stated otherwise, prices on our website are in Pounds Sterling. Unless stated otherwise, prices remain in force until we publish new prices on our website. Delivery charges may apply and are displayed during the order process. Whilst we try to ensure that all prices on our website are accurate, mistakes can sometimes occur. If we discover an error in the price of products you have ordered we will contact you as soon as possible and give you the option of either reconfirming your order at the correct price or cancel it. If we are unable to contact you we will treat the order as being cancelled. If the order is cancelled, we will refund any money that we have received from you.
3.	Availablity:	All orders are subject to availability of products. If products you order are not available we will notify you (where possible) and, if we have received payment for the unavailable products, we will refund them to you within 30 days of your order unless you agree to a longer period.
4.	Content:	We have taken reasonable care to ensure the accuracy of the content on our website, however, in accordance with the applicable laws, we disclaim all warranties (express or implied) as to the accuracy of the information contained in any of the material on our site.
5.	Pre-Ordering Products:	On certain selected items you may pre-order your item to guarantee delivery of the product once we have received stock. The delivery date stated on your pre-order is when we are expecting to receive the product into our distribution centre to send out to you, however this date may be subject to change and we will endeavour to contact you should a change in expected arrival date occur. Should a pre-order item become unavailable for whatever reason we reserve the right to cancel all pre-orders. If you would like any further information on Pre-orders please contact us.
6.	Delivery:	Our aim is to get your order despatched within three working days of receipt of payment. However, please allow up to 30 days for delivery. We will attempt to deliver products ordered by you to the delivery address stated on your order form. If products are returned to us as undeliverable we shall refund the price of the products and our delivery charges less Ł5 or the price of the products (whichever is less) in respect of our postal and administrative costs. You will not become the owner of the products until they have been delivered, at which time they will also become your risk and we will not be liable for any subsequent damage, loss or destruction to them.
7.	Right of Cancellation: (Consumers)	The United Kingdom's Distance Selling Regulations 2000 provide you with a right to cancel your order for products at any time up to the end of the seventh working day following the day after the day on which you received the products. You do not need to give us any reason for cancellation. If you have already received the products you must carefully repackage and return them to us at the above address. Until you have returned the products to us, you must keep them in your possession and take reasonable care of them. We will credit the price of the cancelled products and our delivery charges (if applicable) to you. You will be responsible for payment of the postage charges for return of the products, or our direct costs of recovery should you fail to return the products.
8.	Returns Policy: (Consumers)	In addition to the right of cancellation in condition 7 above, we operate a Returns Policy. If for any reason you are not satisfied with any products bought from this website you may return them to us within 14 days of purchase for a refund, or an exchange provided that the products are returned to us in their original condition and carefully packaged. If the reason for return is because of an error on our behalf or if a product is damaged, defective or of incorrect quantity then when making a refund, we will credit our delivery charges (if applicable). To return a product under this Returns Policy please contact us at 23sheep@23sheep.co.uk. You must carefully repackage and return them to us at the above address. Until you have returned the products to us, you must keep them in your possession and take reasonable care of them. We will credit the price of the cancelled products to you. Our delivery charges (if applicable) are excluded. You will be responsible for payment of the postage charges for return of the products. You must provide us with the original despatch note or other proof of purchase. Nothing in this Returns Policy affects any statutory rights you may have as a consumer.
9.	Returns Policy: (Trade/Business)	If for any reason you are not satisfied with any products bought from this website you may return them to us within 14 days of purchase for a refund (excluding delivery charges) provided that the products are returned to us in their original condition and carefully packaged. A 20% re-stocking fee will be deducted from the value of the refund. If the reason for return is because of an error on our behalf or if a product is damaged, defective or of incorrect quantity then when making a refund, we will credit our delivery charges (if applicable). 10.	Warranties:	All products bought from our website are guaranteed against mechanical failure for 12 months from the date of purchase. If a product proves to be faulty within that period as a result of mechanical failure you may return it to us for a refund or exchange. You must contact us and provide us with the original despatch note or other proof of purchase.
11.	Complaints and Liability:	All complaints should be addressed to Customer Services, 23 Sheep, 7 The Buttermaket, Newark, Nottinghamshire, NG24 1BF, United Kingdom. If products we deliver to you are not as ordered or are damaged, defective or of incorrect quantity you should contact us within 14 days of delivery. We will replace the incorrect, damaged or defective products or make good the shortfall in quantity or, at our option, credit the price and delivery charges of those products to you. If you do not receive products ordered you should notify us within 28 days of the date of your order. We will deliver the products ordered or, at our option, credit the price and delivery charges of the non-delivered products to you, or if we have not accepted your order and have been unable to contact you, we will notify you of the reason for non-acceptance. Nothing in these Terms and Conditions shall be construed to exclude or limit any rights you may have as a consumer to the extent that such liability and rights may not be excluded or limited under applicable statute or law.
12.	Validity:	If any of these Terms and Conditions are unenforceable it shall not affect the enforceability of the rest of these Terms and Conditions.
13.	No Variation or Representation:	Unless confirmed by us in writing, nothing said by our sales personnel shall amount to a variation of these Terms and Conditions or a representation about the nature or quality of our products.
14.	Third Party Rights:	We may transfer our rights under the contract, but otherwise nothing in these Terms and Conditions shall give any person who is not a party to the contract any benefit or any right to enforce any of the terms of the contract.
15.	Governing Law and Jurisdiction:	Your order and the formation of the contract shall be governed by and interpreted in accordance with English law. The English Courts shall have jurisdiction to hear disputes between us.
16.	Twelve Days of Christmas Promotion:	In addition to the terms above, the following apply to the Twelve Days of Christmas Promotion: Dyno Rod will be supplied at a cost of 1p only when all three Twelve Days of Christmas sets have been purchased, although payment will be requested when Set 1 is purchased. We may despatch Dyno Rod separately during December 2007. Dyno Rod must be returned if any of the Twelve Days of Christmas sets are returned or remain unpaid. If Dyno Rod is not returned in these circumstances we will charge an additional £99.99. Offer is subject to availability. The promotion may be ended or amended without notice.
